The Supreme Court today dismissed beleagured Vijay Mallya’s prayer for protection from disclosure of his assets and those of his family, in India and abroad, to Kingfisher Airlines’ lenders, saying “no tangible” grounds have been raised to maintain secrecy of information.
“We don’t find any tangible objection in disclosing the assets (of Mallya, his wife and children) to banks,” a bench comprising Justices Kurian Joseph and R F Nariman said.
The bench directed the apex court registry to furnish to the lenders, a consortium of banks, the details of assets, both domestic and foreign, declared by the former liquor baron of himself and his family members, in sealed cover to the apex court.
The top court, which said Mallya has not complied with its April 7 order in its letter and spirit, observed that “the whole purpose of asking for disclosure was to give a fair idea to banks for entering into a meaningful and viable settlement.”
It asked the Debt Recovery Tribunal in Bengaluru to “expeditiously decide” within two months, the pleas of banks and financial institutions for recovery of their loans.
The direction was issued after Attorney General Mukul Rohatgi submitted that there was “total non-compliance” with the apex court’s April 7 order as Mallya was neither indicating the date of his return to the country to make an appearance before the court nor was he showing his bonafide for reaching a settlement with the lenders by not showing willingness to deposit a substantial part of the amount he owed them.
“He is a fugitive from justice in India,” the Attorney General said, adding the embattled businessman was playing “hide and seek” and cooking “cock and bull story”. Rohatgi said Mallya was “deliberately concealing something from the court” as he had “no intention to come back”.
However, senior advocates C S Vaidyanathan and Parag Tripathi, appearing for Mallya and his companies respectively, submitted that he was a “defaulter but not a wilful defaulter” and “here this is a case of business failure and not that of wilful default”.
Vaidyanathan submitted the accumulated loans of Kingfisher Airlines stood at Rs 16,000 crore in 2013 and all loans were given on the basis of personal assets of Mallya which is in the records of the banks. That being the case the liabilities cannot be attached to his estranged wife living abroad and NRI children who are protected under the law from disclosing their overseas assets, he contended.
Mallya has defaulted on repayment of loans of Rs 9,400 crore to a State Bank of India-led consortium.PTI.
Actress Aishwarya Rai Bachchan today said all information regarding the Panama Paper leaks, in which her name figures, were being given to the government.
The actress’s name had figured in the recent Panama Paper leaks for allegedly having links with offshore entities.
“A statement has been issued and that stands true. A statement has already been given individually as well as by the members of the family. A statement has already been given to the media.
“And rest, all the queries that need to be answered to the government of India is being done. Thank you,” Aishwarya told reporters here at an event, when asked about the Panama Paper leak.
The reported secret list, called ‘Panama Papers’, contains names of about 500 prominent Indians including megastar Amitabh Bachchan and Aishwarya besides politicians and businessmen.
The Panama Papers are a leaked set of 11.5 million confidential documents that provide detailed information about more than 214,000 offshore companies listed by the Panamanian corporate service provider Mossack Fonseca, including the identities of shareholders and directors of the companies.
Earlier, Bachchan had issued a statement saying that his name was “misused” and he was not aware of any of the companies mentioned in the report.
Aishwarya’s spokesperson had also called the information about her name cropping up in the list as “totally untrue and false.PTI..
Citing a large number of cases for probe coupled with acute manpower shortage, CBI Director Anil Sinha has demanded more personnel from states on deputation to the agency, saying if this is not done, the agency would collapse.
Appearing before a Parliamentary Committee, Sinha cited the increase in the number of cases referred to CBI by Supreme Court and High Courts and said the agency’s capacity for investigation was around 700 cases a year which has now almost doubled, necessitating more officers to supervise probes.
As per the submission made by the agency, a total of 1,200 cases and “62 foreign investigations” were pending. Of the total pending cases, 31 are pending for over three years.
A total of 1,531 posts were vacant in CBI as against its sanctioned strength of 7,274, as per the agency’s latest data.
Following the submission, the panel has asked the government to complete cadre review in the agency by June-end.
While deposing before the Committee, the Director, CBI, proposed to provide longer tenure to officers on deputation in the agency from the state and other central forces in addition to other steps taken to manage vacancies, said the report of Department Related Parliamentary Standing Committee on Personnel, Public Grievances, Law and Justice, tabled in Parliament today.
“He, therefore, expressed that unless state governments provide the manpower by way of sending more of their personnel on deputation to the CBI, a time could come that CBI would collapse and fail,” it said.
The Committee expressed deep concern on the state of affairs relating to the vacant positions in CBI.
“It, therefore, impresses upon the Department of Personnel and Training (DoPT) to complete the exercise of cadre review by June 30, 2016, as per the direction of the Supreme Court to deal with the vacancies in the establishment.
“The Committee is apprehensive that unless the present malady of massive vacancy is corrected immediately, the very purpose of establishment of the CBI would be eroded and its credibility tarnished,” the report said.PTI.
RSS Goa unit chief Subhash Velingkar has criticised the BJP-led government over the Medium of Instruction (MOI) policy in the schools.
“Don’t allow these people (BJP) on your doorstep during the election. They have betrayed trust of the voters who got them elected in 2012 election because they promised regional languages as MOI,” Velingkar told a gathering organised by Bharatiya Bhasha Suraksha Manch (BBSM) at Mandrem in North Goa yesterday.
The BBSM – which supports regional language as medium of instruction in schools – began its statewide campaign yesterday from Chief Minister Laxmimant Parsekar’s Mandrem constituency.
Velingkar said the BJP-led state government had assured 12 different incentives for schools in Konkani and Marathi languages when it completed four years of its rule.
“But not a single paisa has been budgeted for these incentives. The announcement was merely an eyewash,” he alleged.
“Now this is agitation of Goan people. We have decided not to bear the lies,” he said adding that “BJP leaders are responsible for their own downfall in the state.”
Notably, Velingkar had earlier also criticised Union Defence Minister Manohar Parrikar and the BJP-led state government over the medium of instruction policy in schools.
However, BJP Lok Sabha MP from South Goa Narendra Sawaikar had taken strong objection to Velingkar’s criticism.
A section of society in the coastal state backs English as medium of instruction in schools. The state government has given grants to such English medium schools, a move opposed by BBSM.PTI
A sub inspector was killed in an encounter with criminals in Dadri this morning, police said.
On a tip off that a wanted criminal Sultan was hiding at a house in Dadri, a police team reached the spot.
Sultan, who is wanted in several cases of loot and murder, opened fire and an encounter ensued in which the SI identified as Akhtar Khan was killed, they said.
Akhtar’s family have refused to conduct his last rites till the criminals are arrested.
“Unless the killers are arrested we will not conduct the last rites,” Akhtar’s elder brother Wahid said.
Wahid also alleged that police personnel in the raiding team fled from the spot leaving Akhtar alone. However, police officials have denied the charge.
The deceased is survived by wife, two sons and a daughter. He hailed from Aligarh.
Akhtar had joined police as a constable in 1998 and later promoted to the post of Sub Inspector. Since 11 June, 2014 he was posted at the Dadri Police Station.
The Supreme Court has sought reply from the Madhya Pradesh government on a plea seeking CBI probe into the alleged disappearance of a UP-based businessman from the state and his production.
A bench comprising justices Dipak Misra and Shiva Kirti Singh also issued notice to Madhya Pradesh ADGP Purushottam Sharma and two others and sought their response in four weeks.
The plea was filed by one Sachin Diwan whose father has been allegedly missing since March 15, 2016, from Dabra in Madhya Pradesh, where he was engaged in work of supply and commissioning of a ‘jaggery plant’ run by the brothers of Sharma.
“That the father of petitioner (a resident of Muzaffarnagar (UP) is missing since March 15, 2016, from Dabra Madhya Pradesh and there is every apprehension that some untoward has happened with him and/ or he is forcibly kept under confinement by the respondent 2 (Sharma) and his two brothers respondent (3&4),” the plea said.
The plea alleged that the senior police official posted at police headquarters at Bhopal has been completely managing and running the plant ‘Priya Organic Jaggery Pvt Ltd’ and due to dispute over payment of dues for the work done on the plant there are apprehension that the father of the petitioner has been kept under confinement.
“The father of the petitioner became the complete victim of the circumstances and the respondent no. 2 used his complete official powers and big status in the state of MP, where the plant is erected and commenced by the petitoner. All throughout the respondents delayed the payment on one pretext or the other, and also entered into an agreement for another site at Datia also in MP, though till date no payment has been received for new work,” the petition further said.
The petitioner said police at Muzaffarnagar is not entertaining the complaint as they have no jurisdiction over the matter and asked him to approach Madhya Pradesh Police or court.
The plea sought issuance of direction to produce the father of petitioner and probe by an independent agency like CBI to inquire into the matter.PTI

The Allahabad High Court has struck down an order terminating the contract of Magsaysay awardee Sandee Pandey as a visiting faculty member by IIT-Banaras Hindu University, holding that the ex-parte action on charges like anti-national activities which have “serious apersions” violated “the principle of natural justice”.
A division bench comprising Justices V K Shukla and Mahesh Chandra Tripathi yesterday allowed the petition filed by Pandey, who had challenged the order dated January 6,
2016 terminating his contract whereby he had been appointed a “Visiting Professor” in Department of Chemical Engineering and his tenure was to come to an end on July 30 this year.
In the impugned order, Pandey, who is also a Gandhian activist, was told that the decision to terminate his contract was taken at a meeting of the Board of Governors of IIT (BHU) which held him guilty of “cyber crime” and acting “against national interest”.
The Board of Governors had taken cognizance of letter from a student of political science at BHU, who had charged Pandey with “involvement in political activities and being an active sympathizer of naxalites”.
Pandey’s counsel Rahul Mishra argued that “decision in question has been taken by the authorities concerned to silence the voice of the petitioner merely because distinctive ideology was practiced by him”.
Quashing the order, the court remarked that “the case in hand is not a termination simpliciter, rather it is punitive/stigmatic order” in which “heavy words such as commission of cyber crime and acting against national interest have been loosely used”.
“All these allegations are serious in nature and such allegations have serious aspersions on the conduct and character of an incumbent and the way manner in which decision in question has been taken ex-parte can not be approved by us,” the court added.
“Here, in pith and substance, the petitioner has been attributed with misconduct and without holding inquiry, violating the principle of natural justice,” the court said adding that the impugned order “clearly casts stigma on the character of petitioner and is punitive in nature”.
Pandey was awarded the prestigious Magsaysay Award in 2002 in the emergent leadership category.PTI

She has won hearts with her acting stint in Bollywood and now actress Sunny Leone has taken up a new role in her career, by turning a writer.
Leone has written a book titled “Sweet Dreams”, which includes 12 short stories.
The “Mastizaade” actress says writing was not on her mind but she did have certain ideas, which went unrecorded.
“Writing wasn’t on my mind. I thought about different stories and ideas throughout the years but nothing really that I wrote down. This is the first time I have written something like this. When I was younger I had a diary, my mother read it, and that was the end of the diary,” Leone told PTI in an exclusive interview.
Set in an Indian milieu, her fictional stories of power and play treat women as sexual equals to men while also talking about the underlying romance.
The 34-year-old actress says when the publishing house, Juggernaut books, came to her with the idea of writing 12 short erotic stories, she took it up as a challenge and finished them in a span of three months.
“Juggernaut came to me and proposed the idea of 12 short stories in this genre. It was a personal challenge for me to able to do it. I took about three months to write those.
The story, ‘7 E’, was the most difficult because that was the first one,” she said.
“So it took me time to figure out the writing style…
Sometimes we had to get straight to the point because it is a short story. That was challenging because you don’t want to move forward so abruptly that a reader loses track,” Leone added.
The “Jism 2” star says the stories in “Sweet Dreams”, currently available exclusively on the Juggernaut app, are fictional and have “nothing that is derived from” her life.
Even though the stories talk about seduction, Leone ensured that she does not cross any line which would make the readers, specially women, feel uncomfortable.
“I wrote these stories, from what I thought a woman would like to read. For me it was important when someone is reading it, specially women, they should not cringe or say ‘it is too much for me to handle’. I wanted it to be in the slightly romantic zone.”
The stories will be released every night at 10 PM till May 3 and the “Ragini MMS 2” actress feels nervous as the journey has been “personal”.
“Now that it is going to release, I am very nervous.
Besides the fact that it is a great avenue to reach out to fans, it was a challenge to see if I can do it, because you have movies and songs coming one after another, but this was personal. I hope they enjoy it.PTI
